Jane Doe et al. v. Central Intelligence Agency et al. Represented the family of a former CIA covert employee who sought to recover injunctive and monetary relief for damages associated with the employee's separation from the CIA. The CIA invoked the State Secrets Privilege claiming the evidence associated with the claims was classified. As part of its defense the CIA refused to allow counsel to securely communicate with the clients who were living overseas or to utilize secure facilities to prepare documents for filing in the case. The District Court dismissed the lawsuit in 2007 and the Second Circuit Court of Appeals affirmed in 2009. Back To Cases
